New York State Funeral Directors Association

Issued June 6, 2019

We are very pleased to inform you that our #1 Legislative Priority - the "Preneed Trust Accountability Act" - has just been passed UNANIMOUSLY by the NYS Senate!

Sponsored by Senator Leroy Comrie, this bill (S.5677A) would require any entity holding preneed funds - such as banks, credit unions and funeral trusts - to undergo an annual audit and thereby make available more information to the consumers (families) who have pre-paid their funeral/burial expenses. At the same time, this bill imposes NO new additional requirements on funeral homes.

This action by the Senate comes on the heels of NYSFDA’s Annual Lobby Day this past Tuesday, which saw 25 of our members representing the Board of Directors, Government Affairs Committee and Bridge Commission come to Albany to round up support for our legislation. Clearly, an impact was made!

The bill now goes to the State Assembly for consideration. If enacted into law, our bill would further strengthen our preneed laws, which are regarded as the best in the nation.

With nine session days left before the State Legislature adjourns for the year, we will now be focusing all of our efforts on the Assembly to bring the bill to the floor for a vote.

You will soon be receiving a Call to Action asking you to contact your State Assemblyperson to urge him or her to support our bill in that house. The Assembly sponsor of the bill (A.7777) is Assemblyman Richard Gottfried.

Thank you for all your efforts on our behalf!

Please be assured that our Government Affairs Team will keep you apprised of any further news on this most important legislation.
